Eminent domain's many gray areas

What is on the ballot:
Voters could decide Nov. 2 whether Mississippi's constitution should be amended to say property seized through eminent domain cannot be given to "any person, non-government entity, public-private partnership, corporation or other business entity" for 10 years.

Exceptions:
The initiative would not apply to roads and bridges, flood control projects, dams, public ports, utilities and in cases of public nuisance and other exceptions identified in the proposal.

What's next:
A hearing will be held July 25 in Hinds County Circuit Court in a lawsuit challenging the ballot initiative.

Where Mississippi ranks:
The nonprofit Institute for Justice gives Mississippi an "F" in property rights laws. Other states' rankings - Louisiana: B; Alabama: B+; Arkansas: F; Tennessee: D-; Florida: A; Georgia: B+.
